AAC/Sunrise House Faces Complaints Over Worker Rights, Safety Violations
The National Labor Relations Board (NLRB) has found merit to union complaints that AAC/Sunrise House unlawfully changed policies and procedures and granted monetary benefits without negotiating with HPAE. In the meantime, in response to several recent incidents of violence at Sunrise House, HPAE filed a complaint with the Office of Occupational Safety and Health Administration (OSHA), the federal agency charged with the enforcement of safety and health in workplaces.
Since the 125 staff members at AAC/Sunrise House voted overwhelmingly in favor of union representation with HPAE on June 29, 2016, the Union has filed multiple Unfair Labor Practice (ULP) charges with the federal government’s National Labor Relations Board (NLRB) regarding management’s violations of workers’ rights under the National Labor Relations Act (NLRA).
After investigating our complaints, the NLRB found merit to certain unfair labor practice charges and will either proceed to trial or settle with AAC if it agrees to rescind the unilateral changes of policies and procedures. The unilateral changes dealt with the implementation of a new information technology compliance and security procedure, as well as the clock-in and clock-out policy.
Several additional ULP charges will be filed by HPAE in the near future.
In the meantime, in response to several incidents of violence at Sunrise House, HPAE filed a complaint with the Office of Occupational Safety and Health Administration (OSHA), the federal agency charged with the enforcement of safety and health in workplaces.
On December 12th a letter was sent to the regional office of OSHA describing several incidents of assaults on workers while caring for patients, urging the agency to conduct an investigation into the lack of worker and patient safety in order to prevent any future incidents of violence.
